Compliance, Enforcement & Penalties
BYERA ensures market discipline and protects consumers by enforcing compliance with the Electricity Law, 2025 and all regulatory instruments issued under it. The Law empowers BYERA to issue and enforce regulatory instruments (such as regulations, orders, guidelines and notices), to issue directions to ensure compliance with licence/permit conditions, and to impose sanctions and penalties where breaches occur.
What this service covers in practice
1) Regulatory instruments and directions
BYERA may issue and enforce regulations, orders, guidelines and notices necessary for regulating the State electricity industry. Where operators are licensed, BYERA can also issue directions to ensure compliance with licence and permit conditions.
2) Compliance monitoring
Compliance is supported through oversight of operator conduct and performance, including review of reports and information required for effective regulation, and monitoring against applicable standards and licence conditions.
3) Enforcement actions
Where BYERA identifies non-compliance, it can take enforcement action in line with the Law and subsidiary legislation. This may include compliance directives, corrective actions, and formal sanctions as appropriate.
4) Sanctions and penalties
The Law empower BYERA to impose and enforce sanctions and penalties on persons who breach the Law or subsidiary legislation made under it.
